What happens to a picture you send us, in plain terms. If anything here is unclear, ask us before you upload it.

Nothing leaves your device until you sign in

Choosing a photograph, answering the question and picking a style all happen in your browser. The picture is held on your own device and is not sent anywhere until you have signed in and agreed to the statement. If you close the tab before then, we never had it.

Who sees it — and this part depends on the style you pick

Your photograph is sent to whichever company’s model paints the style you chose. We are telling you which, because the two are not the same:

• Soft Watercolor and Storybook Illustration go to Google. Their paid terms: your photograph is not used to train anything, and they keep it for up to 55 days for abuse monitoring.
• Cinematic 3D goes to OpenAI, and their terms are different in one way you should know about. If their automated safety system flags an image, a person at OpenAI may review it — and that can happen even under the agreement that otherwise says they keep nothing. Safety systems produce false positives. If you would rather that were not possible, choose one of the other two styles; they are just as good and we would rather tell you than have you find out.

How long we keep it

Your original photograph is deleted 30 days after your portrait is delivered. The portrait itself we keep for a year, so you can come back for it. If you start an order and never finish, everything is deleted after 30 days.

Those are different numbers on purpose. Your photograph is yours and we want it for the shortest time we can manage; the portrait is the thing you paid for.

Children

Before anything is uploaded you are asked to type your name under a statement saying the photographs are yours to use and that you are the parent or guardian of any child in them. We record what you signed, word for word, at the moment you signed it. We ask because we would rather be told than assume.

We will not market at you

We do not send seasonal offers. Some of these portraits are made for people who have died, and there is no version of a holiday promotion that is acceptable to send to somebody in that position — so we do not send them to anybody.

Ask us to delete it

Write to hello@paintedus.com and we will delete your photographs and your portrait. You do not have to give a reason.
